Resources

There are several providers of mediation and arbitration services. Some of these publish standardized rules and procedures, provide panels of eligible neutrals and offer administrative services. Some of the more widely-used providers are listed below with links to their respective Rules/Procedures.   
 
• The American Arbitration Association (“AAA”) publishes detailed Rules and Procedures for arbitration and mediation by type of dispute, such us: Commercial, Construction, Employment, Consumer and International disputes. AAA also publishes standardized contract clauses for use in incorporating the respective rules into a contract for potential future disputes, or into a submission agreement for a current dispute which is not already covered by an appropriate contract clause.

• Judicial Arbitration and Mediation Services (“JAMS”) also offers specialized rules for arbitration and mediation by type of dispute, including: Consumer, Engineering & Construction, Employment and International disputes. These Rules may  be incorporated into a contract or submission agreement by the parties. JAMS also publishes standardized contract clauses to be used for that purpose.

• The International Institute for Conflict Prevention and Resolution (“CPR”) similarly provides specialized rules for arbitration and mediation of a variety of disputes such as: Patent, Construction, Employment and International disputes. The Rules may be incorporated into a contract or submission agreement by the parties.  CPR also publishes recommended contract clauses for incorporating its rules into a contract.
